A Agência Nacional de Transportes Terrestres (ANTT) autorizou a publicação do primeiro edital de reestruturação de um contrato de concessão rodoviária, um marco na regulação do setor.
O edital trata da BR-163/MS, que abrange 845,9 km atualmente sob concessão da MSVia, e estabelece um processo competitivo, permitindo a participação de outras empresas além da atual controladora no certame.
O leilão está programado para 22 de maio, na B3, em São Paulo, e viabilizará mais de R$ 17 bilhões em investimentos ao longo de 29 anos, garantindo a otimização e ampliação da rodovia.
A aprovação ocorreu na Reunião da Diretoria realizada nesta quinta-feira (30/1). Atualmente, outros dois contratos de concessão estão em processo de otimização: BR-101/ES/BA (Eco101) e BR-101/RJ (Autopista Fluminense).
O andamento destes projetos pode ser acompanhado pelo portal da Agência.
BR-163/MS
O lançamento do edital da rodovia, previsto para publicação no Diário Oficial da União (DOU) desta sexta-feira (31/1), é resultado de um trabalho conjunto entre ANTT, Ministério dos Transportes e Tribunal de Contas da União (TCU), para solucionar contratos considerados defasados, como o da MSVia.
A concessionária, responsável pelo trecho essencial para o escoamento econômico e deslocamento no Centro-Oeste, enfrentou dificuldades financeiras para cumprir o contrato inicial devido a crises econômicas e custos operacionais.
“Encontramos uma solução eficiente para evitar a devolução da concessão e garantir novos investimentos por meio de um reequilíbrio contratual seguro e consensual”, destacou Rafael Vitale, diretor-geral da ANTT.
No caso da BR-163/MS, a diretriz da política pública foi estabelecer um modelo que garantisse mais investimentos e menor tarifa em comparação à relicitação, que dividiria a rodovia em dois projetos: Rota do Pantanal e Rota do Tuiuiú.
O contrato reestruturado terá um prazo de 29 anos, sendo 19 anos do contrato original e 10 anos adicionais da otimização.
Comparado à relicitação, o acordo prevê mais obras de ampliação e melhorias no sistema rodoviário, garantindo maior segurança e eficiência para os usuários da BR-163/MS.
Para viabilizar os investimentos, as tarifas são atualizadas, mas os reajustes só serão aplicados após a execução das obras, garantindo que os recursos estejam vinculados às melhorias na rodovia.
O plano também prevê benefícios aos usuários, como isenção de pedágio para motociclistas, desconto de 5% para veículos com TAG e descontos progressivos para usuários frequentes, especialmente os que utilizam o trecho diariamente.
A quantidade e localização das praças de pedágio permanecerão inalteradas.
O Plano de Otimização do Contrato da BR-163/MS prevê uma série de melhorias ao longo da rodovia. Entre as intervenções programadas estão 203 km de duplicação, 147,77 km de faixas adicionais, 28,82 km de contornos, 22,99 km de vias marginais e a execução de seis correções de traçado.
Além disso, o projeto inclui a construção de 99 viadutos, 22 passarelas, 144 pontos de ônibus e 56 passagens de fauna, além da implantação de três Pontos de Parada e Descanso para Caminhoneiros. Melhorias que visam aumentar a segurança, a eficiência e o conforto dos usuários da rodovia.
Nos primeiros três anos do contrato otimizado, está previsto um investimento de R$ 2,06 bilhões para obras prioritárias.
“Com a otimização do contrato, estamos garantindo a retomada dos investimentos na BR-163/MS sem a necessidade de relicitação, que atrasaria as melhorias para os usuários. Esse acordo permitirá antecipar as obras em pelo menos quatro anos, elevando rapidamente o nível de serviço da rodovia, com mais segurança, conforto e eficiência”, reforçou Vitale.
Processo Competitivo
O leilão em formato de processo competitivo tem como objetivo garantir isonomia e eficiência econômica, permitindo a participação de outras empresas interessadas no projeto, além da atual administradora da BR-163/MS.
Para isso, a CCR MSVia deverá disponibilizar ao mercado todos os seus ativos e passivos, ou seja, colocar à venda sua participação acionária no estado em que a concessionária se encontra.
O critério do leilão será o maior desconto sobre a tarifa de pedágio prevista no edital. A atual controladora, MSVia, estará previamente habilitada a participar da sessão pública na fase de viva voz. Caso não haja outros proponentes, a atual controladora será declarada vencedora do processo.
O contrato remodelado deverá entrar em vigor em até três meses após o leilão.
